By accessing and using PatternCanva ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

PatternCanva is an AI-powered platform that enables users to create seamless patterns for commercial and personal use. The Service includes pattern generation, editing tools, and export capabilities.

3. User Accounts

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and identification
• Accept all responsibility for activities that occur under your account

4. Intellectual Property Rights

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of PatternCanva and are protected by international copyright, trademark, and other intellectual property laws.

AI-Generated Content Ownership and Usage Rights: Patterns and designs generated using our Service are owned by you, subject to the terms of your subscription plan and our Commercial License Agreement. Upon generation, you receive:

• Full commercial usage rights for generated patterns
• The right to sell products featuring your generated patterns
• The right to use patterns in print-on-demand (POD) services
• The right to resell patterns as digital assets (subject to plan restrictions)

You may not claim ownership of the AI technology, algorithms, or models used to generate patterns. The AI system itself remains the intellectual property of PatternCanva.

5. Commercial License

Subject to your subscription plan, you may:

• Use generated patterns for commercial purposes
• Sell products featuring patterns created with our Service
• Resell patterns as digital assets (subject to plan restrictions)
• Use patterns in print-on-demand (POD) services

You may not claim ownership of the AI technology or algorithms used to generate patterns.

6. Prohibited Uses

You may not use the Service to:

• Generate illegal, harmful, or offensive content
• Generate content that violates any applicable laws or regulations
• Generate content that infringes upon intellectual property rights of others
• Generate content that promotes violence, hate speech, discrimination, or illegal activities
• Generate content that contains explicit sexual material or depicts minors in any inappropriate context
• Generate content that could be used for fraud, deception, or misrepresentation
• Attempt to reverse engineer or extract our AI models or algorithms
• Use automated systems, bots, or scripts to access the Service without permission
• Generate content that impersonates individuals, brands, or organizations without authorization

7. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the subscription fee and any applicable taxes.

All fees are non-refundable except as required by law or as specified in our Refund Policy.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

9. Limitation of Liability

To the maximum extent permitted by law, PatternCanva shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to indemnify and hold harmless PatternCanva from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last updated" date.
